Federal Court Mandates Freedom of Abrego Garcia from ICE Custody

A federal judge has ruled the immediate release of Kilmar Abrego Garcia from detention by ICE, concluding his ongoing detainment is without legal authority.

"Since his return from erroneous imprisonment in El Salvador, he has been taken back into custody, again without legal justification," the judge wrote in her ruling.

The case originates in a mistaken deportation to El Salvador earlier this year, which US authorities later acknowledged was an error. After his repatriation to the United States to face human smuggling allegations, he was detained in immigration detention.

In her decision, the judge noted that the authorities lacks a current deportation order, which prevents them from deporting Mr. Abrego Garcia "at this time."
